1. General provisions
The following Purchase-Sale Rules (hereinafter referred to as the “Rules”) is a legally binding document which determines the rights, obligations and responsibilities of the Purchaser and UAB Lintella LT (hereinafter referred to as the “Seller”) in purchasing and paying for commodities in the online store “Lovefabrics.eu”.
2. The moment of conclusion of the Purchase-Sale Agreement
The Agreement between the Purchaser and the Seller shall be considered concluded from the moment the Purchaser forms a shopping cart in the online store, indicates his/her correct data and clicks the button “Confirm Order”. Each Agreement between the Purchaser and the Seller shall be kept in the Seller’s database. In cases where the Purchaser does not agree with all or a certain part of the Rules, he/she shall not order.
3. Rights of the Purchaser
The Purchaser shall have the right to purchase commodities in the online store in compliance with these Rules and the procedure established by the online store “Lovefabrics.eu”.
3.1 Commodity return
If the Purchaser purchases a defective product in the online store “Lovefabrics.eu”, he/she may return it in accordance with the Rules for Return and Replacement of Goods approved by Order No. 4-243 of 15 March 2012 of the Minister of Economy. The goods to be replaced or returned must meet the following requirements:
1) The returned item must be labelled.
2) The returned item must not be used, stained or otherwise damaged.
3) The returned item must be in safe packaging, properly prepared and packed to prevent the fabric from damage during transportation.
The Seller undertakes to accept the product of an inadequate quality. Depending on the specific situation, the Seller is obliged:
1) to replace the product of an inadequate quality with the product of an adequate quality or to return the Purchaser his/her money.
2) if the Seller cannot change the purchased product with a similar product, the Seller undertakes to return the money paid for the product.
3) if the Purchaser agrees, to reduce the price of defective products without replacing it with the product of an adequate quality.
Not later than within fourteen days from the date of delivery, the Purchaser must send the application for the return of commodities. The application shall be sent by e-mail firstname.lastname@example.org, which shall include the Purchaser’s name, surname, all available contact information (phone, mobile phone, e-mail), order number, the date of purchase and the date of delivery, the amount paid, the product and a detailed description of the defects found. Upon the receipt of this information, our staff shall immediately contact the Purchaser and settle all the necessary questions. The online store “Lovefabrics.eu” shall cover the costs of shipping the replaced product only if the product is defective. The money for the returned commodities shall be returned within 5 working days from the date of acceptance of the returned commodities.
If it is determined that the product has been damaged due to the fault of the Purchaser, the product shall be returned to the Purchaser only after the costs of return, re-shipping and the product quality assessment are covered, if any.
In accordance with paragraphs 13, 14 and 18 of the Rules for Return and Replacement of Goods approved by Order No. 4-243 of 15 March 2012 of the Minister of Economy, the online store shall not replace or accept the return of commodities of adequate quality. In accordance with this Order, only commodities with manufacturing defects can be returned and replaced with other items.
4. Obligations of the Purchaser
4.1 The Purchaser undertakes to provide the correct data in the registration form. He/she is obliged to report the accurate address of residence and the accurate address of delivery as well as to provide the correct phone number or e-mail address so that the Seller would be able to communicate in case of any uncertainty.
4.2 After composing a shopping cart, clicking the button “Confirm order” and receiving the Final order confirmation to His/Her e-mail, the Seller undertakes to pay the full amount for the goods and delivery expenses. The Purchaser shall pay the order within 4 working days from the date of receiving the Final order confirmation. If the Purchaser fails to do so, the order shall be cancelled.
4.3 The Purchaser undertakes to accept goods on the agreed day and time.
4.4 After the registration, the Purchaser undertakes not to transfer his/her login information to third parties.
4.5 While using the online store, the Purchaser agrees and complies with these Purchase-Sale Rules.
4.6 The Purchaser and other third parties undertake not to copy and distribute the information provided by the online store “Lovefabrics.eu” without the written consent of the website administrator.
5. Rights of the Seller
5.1 If the Purchaser tries to harm the stability and security of the online store or is in breach of his/her obligations, the Seller shall have the right to immediately and without notice restrict or suspend the opportunity of the Purchaser to use the online store, and, in exceptional cases, to cancel the registration of the Purchaser.
5.2 The Seller shall have the right to cancel the Purchaser’s order if he/she fails to pay it within the 4 (four) working days from the date of ordering and pre-invoicing.
5.3 The Seller shall have the right to cancel the order without prior notification to the Purchaser if the Seller fails to contact with the Purchaser within 4 (four) working days because of uncertainties in the order information.
5.4 The Seller has the right to unilaterally change the conditions of these Rules.
6. Obligations of the Seller
6.1 The Seller undertakes to provide the Purchaser with the full access to the online store.
6.2 The Seller undertakes to deliver the ordered commodities at the address specified by the Purchaser.
6.3 During the purchase process, the Seller undertakes to deliver the Purchaser the commodities held in the warehouse within max 14 working days. The Seller undertakes to deliver the commodities which are not held in the warehouse within max 21 working days. The Seller does not warrant that the commodities will always be delivered within the period of time specified in the preceding sentence, especially if the ordered commodities are not held in the Seller’s warehouse. The exact delivery date and time shall be indicated in the Seller’s notification to the Purchaser by e-mail specified by the Purchaser in the registration form. Accordingly, upon entering into the Purchase-Sale Agreement, the Purchaser undertakes to check his/her mailbox until he/she receive the notification on the delivery.
6.4 The Seller undertakes not to transfer the information submitted by the Purchaser (name, address, phone number, email address) to third parties. The information submitted by the Purchaser shall be used for the proper implementation of orders and the deliver of ordered goods to the Purchaser.
6.5 In the event of relevant circumstances, if the Seller is unable to deliver the ordered goods to the Purchaser, the Seller undertakes to offer a similar product and, in case the Purchaser refuses to accept the analogous product, to return the money paid by the Purchaser within 10 working days. In this case the Seller shall be relieved form the responsibility for the failure to deliver goods.
6.6 The Seller undertakes to make efforts to enable the Purchaser to properly use the services of the online store. The Seller does not warrant that the online store will be operating without interruptions or that the data transfer will be free of errors.
6.7 The Seller shall not be responsible for any losses incurred by the Purchaser and caused by malfunction of the online stores and (or) by the data transmission errors.
7. Prices of goods, payment procedures
7.1 In the online store and in the composed order, the prices of goods shall be indicated in Euro including VAT.
7.2 The Seller shall have the right to change the prices of goods without notice.
7.3 After having composed the shopping cart, the Purchaser shall pay for the goods and delivery expenses within 4 (four) working days.
7.4 After the order is confirmed, the preliminary invoice is immediately composed and the order confirmation is sent at the e-mail address of the Purchaser, which includes all the necessary information for the transfer.
7.5 The Purchaser is obliged to pay for the goods and delivery expenses and to accept the ordered goods.
7.6 The Purchaser shall pay for the goods using his/her online bank or by making the payment from any other bank to the Seller’s bank account.
7.7 The Seller’s bank account number is specified in the “Requisites” of the online store “Love fabrics”, in the preliminary invoice or in the order confirmation sent at the e-mail address of the Purchaser.
8. Delivery of goods
8.1 During the ordering process, the Purchaser undertakes to indicate the correct delivery address.
8.2 The Purchaser shall pay delivery costs for ordered goods. The goods are delivered for FREE when ordering merchandise for 100 Euro and more.
8.3 When the Purchaser accepts the goods and signs the letter of conveyance without comment, it shall be assumed that the consignment has been properly deposited.
8.4 The Purchaser shall have no right to make claims against the Seller, if the Purchaser is not able to withdraw the goods on time due to his/her own fault.
8.5 In case of any damage in the consignment wrapping, however, without any non-compliance(s) of quantity, quality and range of goods, the Purchaser or, depending on the case, the representative of the Purchaser must indicate the fact of damage of the packaging in the data storage or the paper delivery confirmation submitted by the representative of the transport company.
9. Assurance of the product quality
9.1 The properties of each product sold in the online store “Lovefabrics.eu” are provided in the product description alongside the product.
9.2 The Seller shall not be responsible for the fact that the colour of goods sold in the online store may not match with the actual colour of goods due to the properties of the display unit used by the Purchaser.
9.3 The Purchaser must comply with all the rules of fabric maintenance. If the fabric quality has been damaged for the non-compliance of the maintenance rules, it is considered the Purchaser’s fault and such product can not be returned.
10.1 The Purchaser is fully responsible for the correctness of the submitted personal data. If the Purchaser fails to submit the correct data or submits incorrect data, the Seller shall not be liable for the resulting consequences and shall be entitled to claim the reimbursement of damage from the Purchaser.
10.2 The Seller shall be relieved from any liability in cases where losses result from the Purchaser’s failure to acquaint with these Rules regardless of the recommendations of the Seller and his/her obligations, even though he/she has been granted with the option.
10.3 The Seller shall be relieved from any liability if the Seller is not able or is temporarily unable to fulfil its obligations due to the force majeure circumstances.
11. Processing of personal data
11.1 The Seller shall collect and use the personal data of the registered user, provided during the registration at the online store, only in accordance with these Rules and for the direct marketing purposes. All information regarding the processing of personal data is confidential.
11.2 The Seller respects the right of each Purchaser to his/her privacy. The Purchaser’s personal data (name, surname, delivery address, phone number, email address and any other information specified in the registration form of the online store) are collected and processed in order to:
11.2.1. process the purchase orders;
11.2.2. issue financial documents;
11.2.3. solve problems associated with the delivery of ordered goods;
11.2.4. fulfil other contractual obligations.
11.3 During the registration at the online store, the Purchaser is obliged to provide accurate and correct personal data. In carrying out the registration, the customer agrees that his/her personal data would be processed for the purposes of data collection and use referred to above.
11.4 The Seller shall send all notifications to the Purchaser at the e-mail address specified in the registration form.
11.5 The personal data (name, surname, delivery address, phone number) specified by the Purchaser in his/her order, are transmitted to couriers that deliver the goods.
11.6 The Purchaser or registered user, who logs in to his/her personal account on the website, shall have the right to modify, update his/her information submitted in the registration form.
12. Final provisions
These Rules are subject to the legislation of the Republic of Lithuania.
All disputes resulting from the implementation or breach of these Rules shall be settled by negotiation, and in case of failure to reach an agreement, in accordance with the laws of the Republic of Lithuania.
